In accordance with the requirements of the EU General Data Protection Regulation, we wish to describe how we process personal data, which information we collect, how we use this data, and which choices you have.

1. Processing data from customers, their employees, legal representatives and other interested parties

In the course of our general business activities, we process the following personal data relating to your person as an interested party or customer, or as an employee or legal representative (in particular as a managing director or executive/supervisory board member) of one of our interested parties or customers.

1.2. Purpose of data processing

The aforementioned data is processed for the following purposes:

  • Processing of the services and products we offer;
  • Maintaining a business partner database;
  • Making information available through our newsletter and other publications.
1.3. Sending your personal data to other parties

If required for the above purposes, we will send your data to the following recipients:

  • Associated legal advisors and supporting professionals (e.g. lawyers, notaries, tax consultants);
  • Banks and credit institutions for processing transactions;
  • Businesses associated with IBS Austria GmbH;
  • External IT service providers;
  • Partners contracted to provide services on behalf of IBS Austria GmbH or its associated businesses, e.g. commercial agencies.
1.4. Storage duration

We will delete your data 3 years after the conclusion of an active business relationship or after the expiry of legally required retention periods, such as in accordance with Section 132 of the Austrian Federal Tax Code, VAT law and/or product liability law.

2. Users of our websites and their data

When you visit one of our websites, we will process some of your personal data. This section explains how we process your personal data in relation to your visit.

2.1. Categories of data processed and purposes of data processing

When you visit one of our websites, we will automatically collect the following data relating to your person:

  • The date and time you accessed a page on our website;
  • Your IP address;
  • The name and version of your web browser;
  • The website (URL) you visited before accessing this website;
  • Certain cookies (see section on cookies below).

We may also ask you to enter personal data on our website, such as your name and e-mail address, in order to provide you with certain services.

There is no obligation to actually enter the data we ask you to provide on our website, but if you do not do so, you will not be able to use the full functionality of the website.

We process your data for the following purposes:

2.3. Storage duration

We will generally store your data for a period of 26 months. Your data will only be stored for longer than this if it is required in order to investigate attacks detected on our website and only until the conclusion of applicable limitation periods, legal retention periods or any legal disputes for which the data is required as evidence. We will also store the data we collect to maintain your user account for as long as your account exists.

2.4. Cookies

This section describes our cookie guidelines and serves to explain how we process cookies and how you can influence this processing.

2.4.4. How do I manage my cookie settings?

If you choose to prevent cookies from being saved or read out on your device, a rejection cookie will be saved on your device so that our website is also aware of your objection. 2.5. YouTube plugins

Our website sometimes uses plugins from YouTube, a site run by Google. The operator of the sites is YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA. When you visit one of our websites that features a YouTube plugin, a connection to the YouTube servers is established when you begin playing the video. This tells the YouTube server which of our websites you have visited. 2.6. reCAPTCHA plugins

To protect input forms on our websites, we may use “reCAPTCHA”, a service provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, hereafter referred to as “Google”. Using this service allows us to identify if the input was made by a human or by automated machine processing for improper or fraudulent purposes. To the best of our knowledge, the data sent to Google includes the following: referrer URL, IP address, website visitor behaviour, operating system/browser/visit duration information, cookies, display settings, scripts, user input behaviour and mouse movements in the “reCAPTCHA” checkbox area. Google uses the data collected in this way for various purposes, including to digitalise books and other printed products and to optimise services such as Google Street View and Google Maps (e.g. house number and street name recognition). The IP address sent via “reCAPTCHA” is not combined with other data collected by Google, unless you are logged in to your Google account when you use the “reCAPTCHA” plugin. If you wish to prevent Google sending and storing data relating to you and your behaviour on our website, you must log out from your Google account before you visit our site or use the “reCAPTCHA” plugin. 2.11. Google AdSense Data Protection Declaration

Our websites use Google AdSense, an advertising program provided by Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA).

Data relating to the displayed advertising material and your IP address may be sent to servers in the USA and analysed there.

Cookies are used in AdSense to enable better advertising, and the cookies contain no personalised data. 2.13.1. Google Analytics IP anonymisation

We have implemented Google Analytics IP anonymisation on this website. This feature has been developed by Google to ensure that this website complies with the applicable data protection regulations and recommendations from the respective regional data protection authorities if they prohibit the storage of the full IP address. The IP is anonymised/masked as soon as the IP addresses contact the Google Analytics data collection network and before the data is saved or processed.

2.13.2. Google Analytics Data Processing Terms

We have agreed a direct customer contract with Google for the use of Google Analytics by accepting the “Data Processing Terms” in Google Analytics.

3. Newsletter subscriber data

When you sign up for our newsletter, you enter your personal data in the online form and give your consent to receive marketing information from IBS Austria GmbH and its associated businesses (collectively referred to as “IBS”).

The data may also be used by

  • IBS sales staff;
  • partners contracted to provide services on behalf of IBS Austria GmbH or its associated businesses, e.g. commercial agencies

in order to contact you, send you offers and provide the best possible support for you or your business.

Our newsletter tool records subscriber behaviour in terms of what they open and click on. Specifically, the following data is tracked: date/time of delivery, date/time newsletter was opened, length of time it was opened for, IP address of device used to open it, mail client used, which link was clicked and date/time link was clicked.

This data is only stored and processed for the purpose of sending subscribers tailored and relevant content. This data is processed exclusively within the European Union and is not sent to third parties or combined with other data. The data is saved until the subscriber unsubscribes from the newsletter.

You have the right to withdraw your consent to receive marketing information at any time with future effect using a link contained in the respective e-mail or by sending an e-mail to [email protected].

Once we receive withdrawal of your consent, you will no longer receive marketing information from IBS on the basis of your prior consent. We delete the e-mail addresses of subscribers who have withdrawn their consent and the associated data (such as opening and click behaviour) once a year.

4. Sending data to other countries

Some of the aforementioned recipients may be located or process your personal data outside of Austria or the EU. In some cases, the level of data protection in other countries does not correspond to the level in Austria. However, we will only send your personal data to countries which the EU Commission has decided offer an appropriate level of data protection, and we take steps to ensure that all recipients offer an appropriate level of data protection.

5. Your rights in relation to your personal data

In accordance with the requirements of the applicable laws, your rights include: (i) to check whether and which personal data relating to your person we have stored, and to receive copies of this data, (ii) to request that your personal data which is incorrect/incomplete or which has not been processed in accordance with data protection regulations be added, rectified or deleted, (iii) to request that we restrict the processing of your personal data, (iv) under certain circumstances, to object to the processing of your personal data or to withdraw any consent previously given for processing, whereby withdrawal of consent in no way affects the lawfulness of the processing prior to withdrawal of consent, (v) to request data portability, (vi) to know the identity of third parties to whom your personal data has been sent, and (vii) to lodge complaints with the data protection authorities.
